Getting Divorced When One Spouse Doesn’t Want to Go Along with the Process Many people believe that if their spouse doesn’t want to get divorced that they cannot get a divorce. In Illinois, this is simply not true. If you want to get a divorce and your spouse doesn’t agree to go along with the process, you can still get one. You still have to have what are known as grounds in Illinois, but just because your spouse is in disagreement doesn’t mean you cannot get a divorce. In fact, if your spouse is served with divorce papers and does nothing, you may be able to get divorced sooner, on your own terms.
